By accessing or using Investors Title Search ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service.

These Terms apply to all visitors, users, and others who access or use the Service. We reserve the right to modify these Terms at any time, effective upon posting on this page.

2. Description of Service

Investors Title Search provides an automated property title search and equity analysis platform for real estate investors. Our Service includes:

  • Automated title searches from county public records
  • Lien and judgment verification
  • Equity calculation and investment recommendations
  • PDF report generation
  • Batch processing capabilities
  • API access (for eligible plans)

  • We are not a title insurance company or closing agent
  • Reports are based on publicly available records and may not include all liens or encumbrances

3. User Accounts and Registration

3.1 Account Creation

To use certain features of our Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the security of your password
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized access

3.2 Account Eligibility

You must be at least 18 years old to use our Service. By creating an account, you represent that you meet this requirement.

3.3 Account Suspension

We reserve the right to suspend or terminate your account if:

  • You provide false or misleading information

4. Payment Terms

4.1 Pricing

Current pricing is available on our Pricing page. We offer:

  • Pay-Per-Search: $49 per standard search (24-hour delivery), $99 per rush search (6-hour delivery)
  • Subscription Plans: Monthly or annual billing with included search credits
  • Credit Packages: One-time purchase of multiple search credits

4.2 Payment Processing

All payments are processed securely through Stripe. By providing payment information, you:

  • Represent that you are authorized to use the payment method
  • Authorize us to charge your payment method for all fees
  • Agree to pay all applicable taxes

4.3 Price Changes

We may change our prices at any time. For subscriptions:

  • Price changes will not affect your current billing cycle
  • We will notify you at least 30 days before a price increase
  • You may cancel your subscription before the price increase takes effect

5. Subscription Terms

5.1 Billing Cycles

Subscriptions are billed in advance on a monthly or annual basis. Your subscription will automatically renew unless canceled before the renewal date.

5.2 Search Credits

  • Subscription plans include a monthly allocation of search credits
  • Credits reset on the first day of each billing cycle
  • Unused credits do not roll over to the next month
  • Additional credits can be purchased separately and do not expire

5.3 Plan Changes

You may upgrade or downgrade your plan at any time:

  • Upgrades take effect immediately with prorated billing
  • Downgrades take effect at the end of your current billing period
  • Credit allocations adjust based on your new plan

5.4 Cancellation

You may cancel your subscription at any time from your account settings:

  • Cancellations take effect at the end of the current billing period
  • You retain access to your subscription features until the end of the period
  • No refunds for partial months
  • You may reactivate your subscription at any time

6. Refund Policy

6.1 Subscription Refunds

We offer a 30-day money-back guarantee for first-time subscribers:

  • Request a full refund within 30 days of your initial subscription
  • Contact support@investorstitle.com to request a refund
  • Refunds are processed within 5-10 business days
  • This guarantee applies only to your first subscription, not renewals

6.2 Search Refunds

100% Money-Back Guarantee

We guarantee a full refund if we fail to find any loan, lien, or other encumbrance on a property. If our report misses a recorded encumbrance that should have been discovered through normal title search procedures, contact us for an immediate full refund.

Individual title searches may be refunded if:

  • We fail to find any loan, lien, or other encumbrance (100% refund guarantee)
  • We are unable to complete the search due to data availability issues
  • There is a significant error in the report that cannot be corrected
  • The search was not delivered within the promised timeframe

Refunds are not available if the property information you provided was inaccurate or if county records are incomplete.

7. Acceptable Use and Restrictions

7.1 Permitted Use

You may use our Service only for lawful purposes and in accordance with these Terms.

7.2 Prohibited Activities

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Share your account credentials with others
  • Resell, redistribute, or sublicense our reports without authorization
  • Use automated tools to scrape or download content (except via our API)
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the Service or servers
  • Upload viruses or malicious code
  • Use the Service to harass, abuse, or harm others
  • Impersonate any person or entity
  • Violate any third-party rights, including privacy and intellectual property rights

8. Intellectual Property Rights

8.1 Our IP

The Service and all content, features, and functionality are owned by Investors Title Search and protected by copyright, trademark, and other intellectual property laws.

8.2 License to Use

We grant you a limited, non-exclusive, non-transferable license to:

  • Access and use the Service for your internal business purposes
  • Download and use reports you have purchased
  • Use our API in accordance with our API documentation (if subscribed)

8.3 Your Content

By submitting property addresses or other information, you grant us a license to use that information to provide the Service. We will not use your search history for marketing purposes without your consent.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

We disclaim all warranties, express or implied, including:

  • Warranties of merchantability and fitness for a particular purpose
  • Warranties that the Service will be uninterrupted, error-free, or secure
  • Warranties regarding the accuracy, reliability, or completeness of information
  • Warranties that defects will be corrected

Title Search Accuracy: While we strive for accuracy, our reports may not include all liens, judgments, or encumbrances. We rely on publicly available county records, which may be incomplete or contain errors. You should:

  • Conduct additional due diligence before making investment decisions
  • Obtain title insurance when purchasing property
  • Consult with attorneys, title companies, and other professionals
  • Verify all information independently

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, INVESTORS TITLE SEARCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

This includes damages for:

  • Lost profits or revenue
  • Lost business opportunities
  • Loss of data
  • Cost of substitute services
  • Property damage
  • Personal injury

Our total liability to you for any claims arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you.

11. Indemnification

You agree to indemnify, defend, and hold harmless Investors Title Search and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including attorney fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your breach of any laws or regulations

12. Termination

12.1 Termination by You

You may terminate your account at any time by:

  • Canceling your subscription in account settings
  • Contacting support to close your account

12.2 Termination by Us

We may terminate or suspend your access immediately, without notice, if:

  • You breach these Terms
  • We are required to do so by law
  • Your account has been inactive for over 12 months

12.3 Effect of Termination

Upon termination:

  • Your right to use the Service ceases immediately
  • You remain liable for any fees owed
  • You may download your reports for 30 days after termination
  • We may delete your data after 90 days

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

13.2 Dispute Resolution

For any dispute arising from these Terms or the Service:

  • First, contact us at legal@investorstitle.com to seek informal resolution
  • If unresolved within 30 days, disputes will be resolved through binding arbitration
  • Arbitration will be conducted by the American Arbitration Association (AAA)
  • You waive any right to a jury trial or class action lawsuit

13.3 Exceptions

Either party may seek injunctive relief in court to protect intellectual property rights.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms on this page
  • Updating the "Last Updated" date
  • Sending email notification for significant changes

Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Investors Title Search.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in effect.

15.3 Waiver

Our failure to enforce any right or provision is not a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer these Terms. We may assign our rights to any affiliate or successor.

15.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control (natural disasters, war, strikes, etc.).
